Right of Withdrawal

a. If the customer purchases both items in standard sizes and standard upholstery materials, as well as items with individual selection or customization by the consumer, different return policies apply. It is important to distinguish between the different items and deliveries.

In the case of items in standard sizes and standard upholstery materials, the customer has the right to withdraw from the contract within 14 days without providing any reason. The customer can revoke their contract declaration within 14 days in writing (e.g., by letter or email) without providing any reasons. The period begins after receiving this instruction in writing, but not before the conclusion of the contract, and not before fulfilling our obligations to provide information as per Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB, as well as our obligations as per § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. However, for contracts concerning the delivery of goods that are not pre-manufactured and for which an individual selection or determination by the consumer is essential, or which are clearly tailored to the personal needs of the consumer, Polev excludes the customer’s right of withdrawal according to § 312g paragraph 2 No. 1 BGB.

Consequences of Withdrawal

If the customer withdraws from the contract, Polev must refund all payments received from the customer, including delivery costs (except for additional costs resulting from the customer’s choice of a delivery method other than the cheapest standard delivery offered by Polev), without delay and no later than 14 days from the date on which Polev received the notice of withdrawal. For the refund, Polev will use the same payment method that the customer used for the initial transaction, unless otherwise expressly agreed; in no case will the customer be charged any fees for this refund.

The customer must return or hand over the product to one of the following addresses at their own expense within 14 days from the date on which they informed Polev of the withdrawal from the contract:

The deadline is met if the customer sends the product before the 14-day period expires.

If the customer cannot return or partially return the received product or its uses (e.g., benefits from use) or can only return it in a deteriorated condition, the customer must compensate Polev for the value loss. A loss of value occurs when the deterioration is due to handling the product in a way not necessary for checking its condition and functionality. The extent of a proper inspection is determined by what would be allowed in a retail store.

This may mean that you still have to fulfill your contractual payment obligations for the period up until the withdrawal. Obligations to reimburse payments must be fulfilled within 30 days. For you, the period begins with the sending of your withdrawal notice; for us, with its receipt.

Special Notes

Your right of withdrawal expires prematurely if the contract has been fully performed by both parties at your explicit request before you have exercised your right of withdrawal.
