Delivery / Retention of title
1. Unless otherwise agreed, delivery will be made from the warehouse to the delivery address specified by the customer.
2. Delivery will be made to the place of use. It is necessary that there is an access, turning and unloading facility for a truck and that the place of use with the packages is accessible. If the delivery cannot be made easily by truck or the place of use is otherwise only accessible to a limited extent, the customer must inform Polev in advance of any possible difficulties that he can foresee so that possible measures and additional costs for ensuring delivery can be examined.
If the customer fails to do so, he is obliged to reimburse the additional costs incurred as a result. For deliveries to the 5th floor or higher, an elevator must be available that can accommodate the furniture packages. If the requirements are not met, delivery will be free curbside. For island deliveries, delivery can generally only be made to the curb.
3. Polev Möbel GmbH will inform you immediately about delivery delays.
4. Ownership of the delivered goods is only transferred to the customer when all of the seller’s claims against the customer have been fully met.
5. Polev Möbel GmbH delivers upholstered furniture within 4 to 12 weeks. Delivery times may be longer for island deliveries. If the aforementioned delivery times are exceeded, the customer must generally set a reasonable deadline before withdrawing from the contract. This obligation does not apply if it is obvious that delivery cannot be made within such a grace period. The above regulation on setting a grace period for the customer applies accordingly.
6. Instead of delivery, the customer can also collect the goods themselves.
a) The customer has the option of collecting the product from our warehouse by arrangement.
b) As soon as the product is available in our warehouse, the customer will be informed by Polev by email.
c) After notification by email, the goods must be collected from our warehouse by the customer within 5 working days.
d) Any costs associated with self-collection are borne by the customer. It is the customer’s responsibility to load and transport the product at their own expense and risk.
e) To identify themselves, the customer must present a valid official photo ID such as a passport, ID card or driving license when collecting the product.
7.The delivery period is agreed individually or stated by us when accepting the order. If this is not the case, the delivery period is approximately 12 weeks from the conclusion of the contract.
8.If we are unable to meet binding delivery periods for reasons for which we are not responsible (unavailability of the service), we will inform the customer of this immediately and at the same time provide the expected new delivery period. If the service is not available within the new delivery period, we are entitled to withdraw from the contract in whole or in part; we will immediately reimburse any consideration already provided by the buyer. Unavailability of the service occurs, for example, if our supplier does not deliver on time, if we have concluded a congruent hedging transaction, in the event of other disruptions in the supply chain, for example due to force majeure, or if we are not obliged to procure the goods in an individual case.
All prices are in Euros and include VAT, without decoration, plus shipping costs. Delivery is available across Germany. The cost and conditions of delivery to other European countries are negotiated individually. Delivery to the islands of Germany is paid individually. Errors and omissions are excluded. The “official price” refers to the optional price recommended to us by the manufacturer.
