Warranty and Liability
1.Polev provides a 24-month warranty on furniture (frames and filling materials). For items that Polev acquires from third parties and does not manufacture itself, Polev provides a 12-month warranty. The statutory limitation period for defect claims is 2 years.
a. To claim the warranty, the customer must promptly submit a warranty request to the following email address: info@delavega.furniture. The customer must provide the order number and, if applicable, the customer number. Additionally, the customer must describe the issue and attach relevant images (only in JPG or PNG format).
b. Once Polev receives the request and images, they will likely contact the customer within two business days to try to resolve the warranty claim.
c. If the product is delivered with damaged packaging during transport, the customer must still accept the product but observe the following steps to claim the warranty:
1. The customer must document the damage in writing on the delivery note before signing.
2. The customer must notify Polev via email (info@delavega.furniture) that the packaging was damaged during delivery. The customer should also indicate whether the product itself was damaged during transport and may attach images.
3. If the customer does not meet these conditions, they are not entitled to the warranty. Statutory provisions regarding defect claims remain unaffected.
d. If delivered items exhibit obvious material or manufacturing defects, or transport damage, such defects should be reported immediately. The customer is not obligated to do so, and it is not a requirement for asserting their claims. However, failure to do so may prevent Polev from making claims against the carrier. Compliance with this provision does not affect the statutory rights of private consumers.
e. Polev does not guarantee that its website will be accessible and error-free at all times, especially when disruptions are caused by factors outside of Polev’s control.
f. If a defect in the purchased item for which Polev is responsible arises, the customer can request a repair or replacement according to statutory provisions. Polev is obliged to carry out the repair or replacement within a reasonable time from the date the customer notifies them of the defect and without significant inconvenience to the consumer. Due to the nature and intended use of the products, Polev is allowed to attempt two repairs if the first one fails. The customer must generally allow a reasonable period for the repair. This requirement does not apply if Polev has been unreasonably inactive following the defect notice, if the repair fails, if there is a particularly severe defect, or if repair is refused or obviously no longer feasible.
g. Polev assumes no liability for defects or errors caused by improper or inappropriate use of the products. In all other cases, liability is excluded unless otherwise specified below. Polev is only liable for damages caused to the delivered item itself; in particular, Polev is not liable for lost profits or other financial losses. If liability is excluded or limited for Polev, this also applies to personal liability of employees, representatives, and agents. These limitations of liability do not apply in cases of personal injury or if the customer has claims under §§ 1, 4 of the Product Liability Act.
2. Only if the customer is a business owner, the following applies:
a. The burden of proof that a warranty defect existed at the time of product delivery lies entirely with the business owner.
b. Furthermore, according to § 377(1) of the German Commercial Code (HGB), in mutual commercial transactions, the appropriate period for notifying defects is one week from the product’s delivery.
c. In the event of warranty defects, Polev reserves the right, contrary to § 439(1) of the German Civil Code (BGB), to decide whether to repair the defect (improvement) or deliver a defect-free (replacement) product.
3. Note on Wood as a Material:
a. Wood is a natural product that shows growth-related irregularities in terms of grain, color, texture, and knots. These are unique to each piece of furniture and do not constitute a defect or grounds for complaints or liability claims. Variations in grain and knots are intentional and are meant to emphasize the individuality of the wood. Despite targeted drying and subsequent storage before processing, external factors such as temperature, humidity, and sunlight can cause drying cracks and warping even years after processing. Oiled wood may appear uneven. Such deviations do not constitute defects and do not entitle the customer to warranty claims.
b. Furthermore, the customer must follow the “Recommendations for Assembly and Use” found on delavega.furniture website.
All prices are in Euros and include VAT, without decoration, plus shipping costs. Delivery is available across Germany. The cost and conditions of delivery to other European countries are negotiated individually. Delivery to the islands of Germany is paid individually. Errors and omissions are excluded. The “official price” refers to the optional price recommended to us by the manufacturer.
